Animals like gorillas and chimpanzees are closely related to humans. But they have no rights. Peter Singer, a professor of bioethics tells DW why great apes should be legally recognized and why animal interests matter.

Gorillas are critically endangered with fewer than 175,000 left in the wild worldwide, according to the International Union for Conservation of Nature (IUCN). The death of Bantu, the last male western lowland gorilla left in Mexico, brought the debate over animal rights back into the limelight, particularly with regard to those those who spend their lives behind bars.

DW had a chance to speak with Peter Singer, professor of bioethics at Princeton University.

You are one of the co-founders of the so called Great Ape Project. What exactly is it all about?

It’s an effort to achieve basic rights for great apes, for chimpanzees, gorillas, bonobos and orangutans, in particular. We know that they are like us in many important ways: that they are complex beings with rich emotional lives, that they are capable of reflecting on their situation, of thinking, of problem solving, that they are self-aware, that they can think about the future. We argue, that in these respects they are so like humans, that we should give them some basic rights. Meaning rights to life, liberty and protection from torture. We would like to see them recognized in the law as people, therefore as beings who can bring a case in the courts. Obviously, through a guardian or advocate, as a small child would bring a case in the courts. But not simply (being seen) as items of property.

Are terms such as “freedom” and “captivity” not merely expressions of our own creation? Isn’t there a difference between humans and animals due to our capacity to think rationally?

That is certainly true. But you can’t explain these concepts to a two year old either, nor to someone with profound intellectual disability. Nonetheless, we do not lock them up and put them on display for others to look at. We don’t perform the kind of medical experiments on them, that have been performed on great apes. Although, fortunately, now medical research on great apes in many countries has been prohibited and that is, I think, partly a result of the work of the Great Ape Project. But given that we think all human beings have some basic rights, irrespective of their capacity to reason or reflect, or think about freedom as an abstraction, then to grant that to all humans beings, but to deny it to chimpanzees and gorillas is simply saying: “Oh well, they are not members of our species, and only our species has rights.” That is simply not defensible. We think it is very similar to racist or sexist ways of limiting the rights of non-european races, or those of women, as it has happened in the past.

Some argue that zoos serve an educational purpose. An irreplaceable meeting place for man and the animal, without which we would not care about them so much…

I am not aware of any evidence that looking at animals in captivity inclines us to care more about them. I suspect that one major lesson that people absorb through caged zoos is that we have the right to confine animals and use them as, basically, forms of entertainment. I think the educational lesson would be better, if they were kept in much larger enclosures where they can live a more normal life for their species. We would learn much more from that and we would also learn greater respect for them.

You are an advocate of the philosophical current called Preference Utilitarianism. What does this mean with regard to animals?

I am a utilitarian. I think that the right action is the one that has the best consequences. In terms of what those consequences are, utilitarians classically have referred to pleasure and pain. Preference utilitarians refer to the satisfaction of preferences. Whichever form of Utilitarianism we take, it’s clear that animals come in, because they do experience pain and pleasure and animals do have preferences, obviously for avoiding pain and experiencing pleasure, as well as perhaps many other preferences as well. And we are not justified in disregarding or discounting those preferences or those pains and pleasures, just because they are not members of our species. That is why from a utilitarian perspective, animals clearly do have a kind of moral status, that means that we have to consider their interests, and we should not regard those interests as less significant than ours, just because they are not members of our species.

In your book “Animal Liberation” (1975), widely considered to be a pioneer piece of work within the realm of the animal advocacy movement, you discuss the rule of man over animals. Does the apparent growth in interest around topics such as vegetarianism and the defense of animal rights reflect a shift in the greater public consciousness?

Today there’s a greater interest in animal rights, and in part that certainly has something to do with a shift in our diet. Particularly away from factory farmed animal products. Also, I believe there is an increasing recognition that this is environmentally not sustainable, and that it contributes to climate change. So I think that there are a lot of factors that are leading to a significant increase in interest in vegetarian and vegan diets. And I’ve noticed through traveling in many countries that vegan options have become available. Ten years ago you would not have found them.

You have often talked about your positions on assisted dying and suicide, pleading that one should be able to decide freely when to end his or her life. How does this apply to animals?

I think there are differences between different kinds of beings in their capacities to choose their own death, and this would be true with humans as well. You have to be of a certain age, and mentally competent in order to receive physician assistance in dying, in those jurisdictions in which it is legal, for example the Netherlands or Belgium or more recently Canada, and some states of the United States. Non-human animals don’t meet those conditions, and therefore others do have to make that judgement. Sometimes, and I think anybody who has had a cat or a dog might be aware of this, animals become ill and are clearly suffering, and there is little hope of recovery. Then we have to make a decision for them, and that should happen in zoos as well.

You travel a lot. Which general differences in the protection and treatment of animals do you encounter?

I have seen significant improvements in Europe over the past couple of decades, particularly with regard to factory farming. Some of the worst forms of confinement have been prohibited, for example the standard battery cages for egg laying hens. Those are advances which, to the best of my knowledge, do not exist in Latin America. So in general you’d have to say that the region needs to catch up with where Europe is on that kind of progressive legislation. Also on matters like the testing of cosmetics on animals. So there are problems, and not only in Latin America, but also in Asia. Very severe problems in China in terms of animal welfare, where there is really a national animal welfare war.

Why do you think is it so difficult to get through claims for better living conditions for animals in zoos, let alone a ban on keeping apes and other animals in them?

It is always hard to produce change against established interests, and zoos have been doing what they’re doing for a long time. Especially when you have urban zoos with rather limited amounts of land, it is very hard for them to change, because they just do not have the space to provide the proper conditions for animals.

They would have to greatly reduce the number of animals and the variety of different species that they have. For this they worry that people would not come to visit them anymore, so it is a constant struggle. I think we really need to get zoos out of these urban areas where they don’t have enough space, and move them outside cities where they can be more like a sanctuary or wildlife park, and provide dignified conditions for animals.

Facing an uphill court fight, the US Fish and Wildlife Service announced
last week it was formally
removing the lesser prairie chicken from a federal protection list under
the Endangered Species Act.
This move follows recent court rulings in Texas that stripped the lesser
prairie chicken of federal
protection. However, federal officials say the removal doesn’t mean
authorities had concluded the
lesser prairie chicken didn’t warrant protection for biological reasons.
The agency stated “The service is undertaking a thorough re-evaluation
of the bird’s status and
the threats it faces using the best available scientific information to
determine anew whether listing
under the ESA is warranted.”
The previous rulings found that the Fish and Wildlife Service failed to
make a proper evaluation
of a multi-state conservation plan when it listed the lesser prairie
chicken as threatened.
Oil and gas groups had strongly opposed the threatened listing and
ranchers also opposed the
listing.
The lesser prairie chicken’s Great Plains habitat has shrunk by more
than 80 percent since
the 1800s and its population by 99 percent.
It lives primarily in Kansas. However, it also lives in Texas, New
Mexico, Okla. and Colorado.
To keep the birds off the endangered species list, these five states
organized their own
conservation program. It offers economic incentives to landowners and
companies who set
aside land to protect the birds.

The lawsuit says “deadly leg-hold traps” set for cougars could snare wolves and jaguars, both protected under the federal Endangered Species Act, as well as female cougars with kittens, which are protected under state law.

There are an estimated 97 Mexican wolves in the wild in Arizona and New Mexico, officials have said, despite a federal program to recover the species. Jaguars — the largest cat species native to the Western Hemisphere — are far more rare in the U.S., after being driven to the brink of extinction by “human-caused factors like poaching and trapping,” the lawsuit says. It also names the state Game and Fish Department as a defendant.

Humane Society attorney Nicholas Arrivo, in a phone interview Tuesday, said the trapping program presents “a pretty unjustifiable risk to nontarget animals.”

Mexican wolves, jaguars and cougars share overlapping territory in New Mexico, Arrivo said. “Traps that are set for cougars are not intelligent. They are indiscriminate machines that will snap shut on any animal unfortunate enough to cross its path,” he said. He likened traps to land mines, saying both are “brutal, unnecessary and indiscriminate as to what they take.”

The State Game Commission could not be reached for comment on the case.

Lance Cherry, a spokesman for the state Game and Fish Department, said in an emailed statement Tuesday that the suit “is only a distraction; the rule was crafted after nearly a yearlong process of public and scientific scrutiny, including consideration of potential impacts on endangered species. The Department will vigorously defend the rule, which is part of a world-class effort to manage New Mexico’s wildlife.”

The State Game Commission reviews the rules for hunting and trapping bears and cougars every four years. In 2015, the panel held five public meetings on the topic before approving changes in August that cleared the way for “sport harvest” trapping of cougars on private and state trust lands between Nov. 1 and March 31 without a special permit. The new rule also doubled the number of cougars a hunter or trapper can take in some areas, increasing the kill limit in those lands to four from two.

Representatives of the New Mexico Council of Outfitters and Guides, the New Mexico Trappers Association and the New Mexico Cattle Growers’ Association spoke in favor of the proposed changes at a hearing in August.

But numerous other residents spoke in opposition, including Animal Protection of New Mexico’s wildlife campaign manager, Phil Carter. He cited a 2015 poll of 1,000 New Mexico voters, saying that “across the board” those surveyed opposed the changes — and trapping in general — by a 3-to-1 margin.

“That is consistent across every congressional district in the state and every political party,” Carter said at the hearing.

Retired elementary school teacher Jean Ossorio and her husband, Peter Ossorio of Las Cruces, have signed on to the suit as plaintiffs. They’ve been Mexican wolf advocates for more than 20 years and have volunteered for many federal wolf recovery efforts, along with outreach and education activities.

According to the complaint, Jean Ossorio has attended “virtually every state and federal public meeting pertaining to Mexico wolf recovery” since 1998.

The couple could not be reached for comment.

Carter, at the August hearing, accused the State Game Commission of using outdated data to draw its conclusions about cougar populations.

“This is not about sportsmanship,” he said. “This is about killing.”

Animals have no voice in our wilfully deaf and conveniently anthropocentric, speciesist culture. Despite their clearly having consciousness (for those with eyes to see and ears to hear) and high levels of sapiency as well as sentiency, (which any of us who have had any sort of genuine relationship with a non-human being cannot fail to recognize,) their many languages are not understood by the majority of our fellow humans.

The failure is not on the animals’ part; it is on ours. Not even familiar canine, feline and equine languages, or methods of communication, are comprehended by the vast majority, after all these many aeons of loyal, devoted companionship, friendship and service. And this despite the fact that our fellow beings, (and especially those who are in close relationship with us) have more than managed to learn our own languages. They understand and interpret not only our many, different verbal requests, whether in French, Russian, Japanese, Arabic or Spanish, (all too frequently delivered as arrogant, dominionist commands, unfortunately) but also our physical body languages and our energetic, non-verbal (if you like, telepathic) communications. They read our emotions.

But, tragically, our determined, utilitarianist habits of exploitative thinking and living, deny them any right of response or recognition. We have reduced our highly evolved, non-human kin to mere “things,” to “livestock”, to “experimental subjects,” to “specimens,” – to commodities, to so many “its.” Our blatantly self-serving reductionism has deliberately negated their individuality, their conscious existence and experience, their personalities and their souls. We have disingenuously dismissed all their emotional, psychological and spiritual complexities (which we have barely even begun to fathom, having not wanted to look for so long,) to a simplistic, mechanized “instinct.”

Ours is the herd mentality.

How guilty and remorseful we would all feel if they spoke back to us in a language we couldn’t fail to understand, and we were actually forced to listen! (The Bible’s story about Balaam’s ass makes just this point. And the Divine is clearly on the poor ass’s side.)

It is here that the enlightened writer needs to come in. Our moral and our creative duty is to convey their point of view; to translate it for those who seem unable (or unwilling) to comprehend it otherwise.

The writer is by nature and disposition an empath. The writer is sensitive, observant and importantly able to engage with the experience of another. The writer’s heart is mostly wide open. (Very few respond to the writings of a closed heart. Clever, clever, mind-only writings simply don’t touch us. They pass through our own minds as just another load of ego-centric baloney; ‘intelligent’ perhaps, but abstract, cold. The world is not transformed by them in any way at all.) A good writer feels, sees fully, hears everything, actually dares to bear witness to what is, on all levels – and thus, thankfully, has a different, more developed lens of perception to share.

Writers who write about animals, about their fellow beings, care. We care very deeply. Our compassion and understanding, our capacity to connect, are highly developed. That is why we write. Because we cannot just remain silent. Having uncovered, having discovered, having born witness to the living hell that is most animals’ experience at our hands, we have to make use of so often inadequate, man-made words to pierce through the cold walls of human indifference.

We have to touch. We have to bring viscerally to life. We have to use the power of truthfully observed detail, noticing everything (inside and out) feeling everything, to rekindle the embers of better being in us all, to remind us of our tragically long-forgotten inter-species unity, of our sameness, (and not our petty differences). We have to break down centuries of hardened, calloused indifference.

Abstractions and vast statistics simply don’t touch the majority. If they cannot, as readers, imagine themselves inside the experience of the suffering other, if they cannot identify, they will not be motivated to make personal changes, and to fight for change. Reading is a co-creative process – and it requires the writer to have gone there fully first; to powerfully evoke.

Writers who have the conscience, kindness and commitment to actually write about animals, who have the courage to look their suffering directly in the eye (a tough, torturous path, though very necessary) who have the devotion to their animal brothers and sisters to dedicate themselves to ending all the terrible oppression, all the atrocity, abuse and pain – must never be held back by that old, bitter and selfishly motivated accusation of “anthropomorphism!”

To empathise is not to fantasize or to project at all – but rather to recognise fellow suffering when we see, hear, smell, know and touch it. To empathise is to connect to the vivid reality of another. It is to make real, to embody the cosmic Golden Rule to “Do as you would be done by” and the Silver Rule to “Not do as you would not be done by.” It is love in action.

There is nothing sentimental whatsoever about this compulsion at all. It is, in fact, our highest calling. And there should be no apologies for it either.

Where would we be if we had failed to empathize with the many victims of the slave-trade, of vicious, racist and sexist attacks, of war, terrorism and famine? Where would all the children be, all the people with learning difficulties and mental health problems, all the political prisoners who suffered so long at human hands, if we had failed to finally empathize with their plight, to bring it to light so that others could feel it for themselves – and thus demand change?

By contrast, sentimentality is to imagine what is not there. It is to dump idealized longings onto others for our own selfish sakes. It is to bypass reality.

That is not what writers who empathize with their fellow beings do at all. Writers who empathize connect again, (where most have disconnected,) and report back. We do this in order to wake ourselves and others up, to shake us all out of our self-centred reveries, to pour a cold bucket of water over our conveniently slumbering consciences. We cry out with everything we have in us: “Have you seen what’s going on here? Will you please look! How can you bear it? Do something! We each have a moral responsibility! They are just like us – how can you not care?”

Writers who empathize force us all to look at what we each are doing, what we are colluding in, what weare contributing to. We are forced to take responsibility for our negative day-to-day choices that directly correlate, incrementally, to immense, unimaginable, abominable animal suffering. Empathic writing cuts through all those guilt-filled attempts at avoidance and dismissal, the desperate pleas of “don’t tell me, don’t tell me – I don’t want to know!”

I say it again, there must be no apologies. It is our violent culture that is so wrong, not the courageous writers who dare to expose this violence. It is not the writer who should modify his or her approach for fear of upsetting the oppressors, the animal abusers, the exploiters and the colluders, for fear of public ridicule – but rather the oppressors, the animal abusers, the exploiters and the colluders who should hang their heads in shame.

The time will come when we will look back on this longest of struggles, this most devilish of slaveries – the enslavement of our vulnerable, innocent, animal kin, (who should have had our protection,) as we now do on human slavers, on human murderers, on rapists and paedophiles. (Let’s not forget all the ‘licensed’ animal brothels currently open across the world, and the crush video sadists who are making a fortune in this twenty-first century.) It is the unenlightened who need to apologize and repent for their cruel abominations – not the empathic writers who seek to understand and communicate the hidden truth.

I would rather be accused of “anthropomorphism!” and “sentimentality!” any day, than of animal rape or animal murder. I would rather care too deeply (is there such a thing?) than not enough. I would rather be accused of being over-soft, than over-hard. I would rather love, than hate. And I would far rather be defined as a bunny-hugger than a bunny vivisector, a bunny killer, a bunny torturer, an angora wool-puller, a blood-covered, live animal skinner.

Let us never be ashamed. Let us write passionately and movingly on behalf of our suffering, animal kin, in order to shine the most powerful light we possibly can, the Divine light of creativity, on the world’s man-made darkness. Let us break open hearts in the process, so that healing can begin. As Francis of Assisi said, “A single sunbeam is enough to drive away many shadows.”

Let us write without any fear of retribution or of societal reprimand. Let us remember the billions of animal victims instead, and forget our human accusers.

One day they will thank us for it. One day they will try and claim they too were part of the resistance.

Americans more than ever are concerned about animal welfare, but it’s hard to suss how much Hillary cares about it

Hillary Clinton’s campaign has wisely caught on to an evolving voter dynamic by crafting a position paper outlining her support for protecting animals. But is she for animal rights or for animal welfare?

In addition to being good policy, courting the animal protection vote is good politics. Americans’ concerns about humane treatment of animals is stronger than ever before.

If this trend continues – and there is no reason to expect that it will not – the issue will likely play an even larger role in future elections.

Evidence of society’s rapidly evolving focus on animal protection abounds. In March,SeaWorld announced that it will stop breeding orcas and will phase out its orca shows, which are its signature attraction. Last month Ringling Brothers put on what it called its last elephant show ever. Last year McDonald’s joined Burger King, General Mills, Sara Lee and several other corporations that have announced they will only use cage-free eggs in their food products. In 2014 South Dakota became the 50th state to upgrade animal cruelty to a potential felony. Only 20 years earlier, all but a few stateshad only misdemeanor penalties for animal cruelty.

A 2015 Gallup poll addressing animal rights may be even more compelling. According to the poll, almost one in three Americans – 32 percent – now believe that “animals deserve the exact same rights as humans to be free from harm and exploitation.” In an identical poll Gallup conducted in 2008 only 25 percent of respondents expressed this view.

Clinton’s position paper does not go this far. It provides a vaguely worded list of mainstream animal welfare concerns such as “strengthening regulation of ‘puppy mills’” and “encouraging farms to raise animals humanely.”

The most interesting aspect of  Clinton’s position paper is its description of the candidate as having “a strong record of standing up for animal rights.” “Animal rights” is a loaded term, and even animal rights supporters cannot agree as to what it means. Some animal rights advocates interpret the term loosely, and view animals as already having some rights because laws exist to protect them.

But other animal rights supporters assert that animals presently do not have rights, because our legal system views animals as property and does not allow them to be represented in judicial proceedings. Highly publicized lawsuits are underway in New York seeking to change this for chimpanzees by demanding that they be considered “legal persons” for purposes of protecting their “bodily liberty” and their “bodily integrity.”

Have you ever noticed how people who love country music are more likely to be right wing? Or how climate change sceptics are more likely to be anti-abortion? Throughout society there are examples of beliefs that seem to occur together, despite having no obvious conceptual link. The reason for this is because for most of us beliefs and world view are not the result of carefully weighing up the evidence, but are actually held as a way of belonging to a subculture. So we form subcultures within our society to give ourselves a sense of belonging. We support sports teams and get into fights with fans of other teams, we choose to follow a certain genre of music and sneer at other genres, or wear preppy clothes, goth clothes, hipster clothes, anything to define ourselves as part of a tribe. And, as well as applying this desire to the clothes we wear and the music we listen to, we subconsciously apply it to our ethical and political beliefs.When you think about it, there is absolutely no conceptual link between the arguments for high or low taxes, and the arguments for or against legalising abortion. Yet in the English-speaking world there is a rough correlation between people wanting lower taxes and being anti-abortion, and vice versa. The best explanation for this is that these beliefs are identified as flags for certain subcultures that people want to belong to.This view is supported by evidence that shows people respond differently to the same argument when attributed to different sources. One study presented the argument for vaccinating children and recorded people’s responses. Right-wing individuals were significantly more likely to agree with the argument when it was attributed to a well-known right-wing figure than when it was attributed to a well-known left-wing figure. Other studies have shown similar behaviour from left-wingers etc.Studies of the effects of wearing a chastity ring show just how powerful the need to belong really is. When a student is part of the chastity ring movement in a school where everybody else wears the ring too, he or she is no more likely to abstain from sex than an average teenager. And when there is almost no one else who wears a chastity ring in the same school, there is still no effect. However, when just the right amount of other students are also part of the local chastity ring movement, wearing the ring does marginally boost commitment to abstinence. This suggests that when everyone in the whole school is wearing the rings, no one feels like they belong. Equally, when almost no one else wears the ring, there is no tribe to belong to. But when there are enough others to feel like you belong to something special, you’re motivated to make the effort to stay part of the club. Such is the power of wanting to belong, it can even override the natural human desire for sex.It’s clear from all this that the desire to belong is a pretty powerful drive, so if you want to convince a large group of people of something, you had better not be working against their natural tribal urges by appearing to be from another side. I believe that one of the animal rights movement’s biggest problems is that we are associated with hippies, and that we’re seen as being on the same team as the New Age movement (whale song, homoeopathic medicine, and so on). I think this hinders us, because people who might otherwise be open to our arguments will close themselves off because they think we’re on the “other team” – a bunch of hippies who are anti-patriotic and probably anarchists too.I think the animal rights movement has to transcend subcultures and everyday political factions, because otherwise we’re only ever going to appeal to the counter-culture. But we really want to be changing the views of everyone, including mainstream culture. There are potential vegans across the political spectrum, if only we weren’t perceived as being part of the hippie counter-culture team. One of many examples is the type of conservative person who loves the countryside, hates to see it ruined by massive factory farms, doesn’t like to see traditional local species of bird disappear, and loves dogs and horses. Someone with views like that only needs to join a few dots between their beliefs to become committed to animal rights and environmentalism, but they’ll be less likely to do that if they feel they’re changing teams.

Another downside to being associated with the New Age philosophy is that this movement often conflicts with science. And unfortunately, a lot of people believe that Veganism and Vegetarianism conflict with science too. This is manifestly not the case, as there is an established scientific consensus that a well-balanced vegan diet can be very healthy, and indeed, a number of elite athletes, such as bodybuilders, Olympians and Iron Man competitors choose such a diet. Equally, vegetarians have longer life expectancies than meat eaters. Science, and the facts, are on the side of vegans and vegetarians, but we often get lumped in with wacky New Age diets.There are ways to change the perception of the animal rights movement. For God’s sake don’t play bongos at a protest! I’ve been to a few demonstrations and advocacy events, and I always make sure to dress as smart and as clean cut as possible, to try to subvert the stereotype, and to make it clear I’m not a raving hippie who can be safely ignored. I think everyone should make this effort as much as possible when advocating animal rights. And animal rights groups should try to promote spokespersons who demonstrate the ordinariness of being vegetarian or vegan. Perhaps a few less campaigns featuring skinny white bohemian artists, and a few more featuring people from other backgrounds, such as doctors, athletes and people of different races. We must also welcome people of all political persuasions – wanting low levels of immigration, for example, should be no barrier to being part of the animal rights movement.There will always be divisions in society, left-wing and right-wing, culture and counter-culture, liberal and conservative. If we want animal rights to be accepted by everyone, we have to transcend cultural tribalism.
